Federal Judge Mandates Release of Abrego Garcia from ICE Custody

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without legal authority.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The case originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to answer alien smuggling allegations, he was detained in federal detention.

In her order, the court noted that the authorities does not have a current deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

The legal proceedings involve conflicting assertions. While the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically disputes this claim.

He has also pleaded not guilty to the smuggling charges, which are part of a ongoing criminal case in Tennessee.

The judge, who was hearing his petition to removal in a federal court, ruled that he must now comply with the terms of his bond from jail in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
